PRIVACY POLICY CLOUDFERRO
When you contact us or you use our services as a natural person (individual), regardless of whether you act on your behalf or on behalf of another entity (e.g. your employer and our customer), or when your data has been disclosed to us (e.g. as contact details for the purpose of performing of the agreements), CloudFerro processes your personal data.
The following information is intended to explain to you who we are, how we obtain information and what we do with this information in business relations. If anything is unclear for you or casts your doubts, please contact us.
I. Who are we and how to contact us?
CloudFerro sp. z o.o. based in Warsaw, Nowogrodzka 31, 00-511 is the controller of your personal data (hereinafter „the Controller”) within the meaning of the GDPR, with regard to your personal data provided during registration on our website: www.cloudferro.com (hereinafter „the Website”) or otherwise provided to the Controller (e.g. contact form, paper questionnaire).
With regard to personal data you place (so-called content) in our cloud:
- if you are a consumer, we are the Controller of such personal data,
- if you are an entrepreneur or an institution, we are processing such personal data at your command.

II. What categories of personal data do we process?
The scope of personal data we process depends on the information provided to us by you or, e.g. by your employer / principal with regard to the conclusion and performance of the agreement. The categories of personal data we process are in particular:
a) identity provided in the registration form, including name and surname;
b) contact details, including correspondence address, telephone number, e-mail address or other contact details;
c) financial data, including data of payment for services rendered by us;
We collect the personal data directly from you or from other persons, e.g. from your employers / principals.
III. For what purposes and on what legal basis do we process your personal data?
We process your personal data left on the Website or provided by you in purposes:
a) to conclude and perform the agreement with you, in accordance with Article 6.1. b GDPR;
b) to conclude and perform the agreement with your employer or principal, in accordance with Article 6.1. f GDPR;
c) to perform legal obligations of the Controller, e.g. obligations arising from the Polish Tax Ordinance or the Polish Accounting Act, in accordance with Article 6.1. c GDPR;
d) to implement our legitimate interest, in accordance with Article 6.1. f GDPR, for:
a. answering questions asked via e-mail or via contact form at the Website, including questions and issues regarding our business operations and other correspondence with you;
b. establishing, pursuing or defending claims;
c. improving quality of our Website by using cookies technology, which allows our Website to function properly, as well as by analyzing information about how you use our Website, e.g. what do website Users click most often, when do the traffic increase etc.).
Providing your personal data is voluntary, however, sometimes it may be necessary for purposes regarding our cooperation, e.g. necessary to conclude or perform an agreement or to answer an inquiry or to correspond. This means that failure to provide your personal data may sometimes constitute basis for CloudFerro's refusal to cooperate or for taking legal action to resolve issue.
IV. How long do we process your personal data?
As a general rule, your personal data will be processed only as long as it is necessary due to the purpose for which your personal data is processed, including:
a) in order to fulfill our legitimate interest, your personal data will be processed until the objection is made or the purpose for which they were processed is achieved;
b) for the purpose of ongoing contact with you, if you are not our customer, we store individual information, depending on the category, for a period of several weeks (cookies) to a maximum of 2 years (more detailed queries and conversations that may be relevant to our contact in the future);
c) in order to perform the agreement, we keep the personal data for the duration of the agreement and usually for a period of up to 7 years after its termination, which results from tax regulations and the limitation period for certain claims;
d) we process "actively" the personal data processed on the basis of your consent until your consent is withdrawn, however, for the purposes of pursuing any claims, we process such data (we store it) until the expiry of any claims.
These retention periods may be subject to an appropriate and necessary extension in case of any claims and court proceedings - for the duration of these proceedings and their settlement - as well as if the law in certain cases obliges us to process them longer.
V. Who has access to your personal data?
Access to your personal data is gained only by:
a) authorized employees or associates of the Controller who are obliged not to disclose the personal data and not to use them for purposes other than those for which we obtained your personal data;
b) entities that support us in providing of services, i.e. entities providing advisory, auditing, accounting, tax and legal, debt collection, IT, banking, archiving and destruction of documents, marketing services; entities providing parcel and mail delivery services, entities that you can use when using our services, i.e. entities that operate payments.
All those people who have access to your personal data are people who need such access to perform specified actions.
We may also be required to provide certain information to public authorities for the purposes of proceedings conducted by these authorities. In this case, information is provided only if there is a proper legal basis for it.
VI. Your rights
You have the following rights: right of access to your personal data and to obtain a copy of it, right to rectification of your personal data, right to erased (right to be forgotten), right to restrict processing.
However, you have the right to object to processing your personal data when the processing is based on the legitimate interest of the Controller, on the grounds relating to your particular situation, and in case of processing for direct marketing – also without any grounds.

If you have doubts about the lawfulness of the processing of your personal data, you have the right to file a complaint with the supervisory authority, which in Poland is the President of the Personal Data Protection Office.
